Abstract

After the rolling reform era, Indonesia was once considered a model of a tolerant country. A place where religion and democracy can coexist. However, over the last five years that image has been called into question. The emergence of various phenomena, such as the burning of the house of worship in Tanjung Balai and the mass mobilization to protest the former Governor of DKI Jakarta Basuki Tjahja Purnama (BTP) or who is more familiarly called Ahok, shows the tendency of intolerance in society to spread to several parts of Indonesia. The State Revenue and Expenditure Budget is allocated 20% for education. Ministry of religion, in 2021 allocates 55.88 trillion (83.46%) for education (ed.: religion and religion). With a budget of this size, people often ask whether such a large budget can have a positive impact on Indonesia's progress, especially from the harmony and harmony of the Indonesian people in building the Indonesian nation. Indonesia itself adheres to a mono-religious view which regulates religious and religious education. However, there are also schools or colleges that carry out religious education with an inter-religious model. Abstract

The competition in the manufacturing industry is currently moving very fast. Competitive advantage, increased production effectiveness in operational activities, continuous performance improvement and business strategy Good quality is something that manufacturing companies must pay attention to to be able to compete globally. PT.X is a manufacturing company that specializes in repairing Automated Teller Machine (ATM) machine spare parts. In the process of repairing this spare part, there are problems with the use of the application system, the number of parts that cannot be repaired as before and the performance of employees is lacking, causing waste. This waste has an impact on performance and operational activities being not optimal and hampering the process of repairing spare parts. The lean manufacturing approach aims to identify and eliminate waste that occurs during operational activities in order to be more efficient and effective with the method Value Stream Mapping (VSM) for mapping the flow of spare part repairs and information flow, identifying waste which is divided into 7 categories and conducting analysis. The root cause of waste with fishbone diagrams, the result of which is the cause of waste by humans, is the lack of insight or knowledge of employees, machines that are damaged due to continuous use and the methods used by the company are not appropriate. The results of the identification of waste are waste waiting, transportation, processing, inventory and defective products. Abstract

This research focuses on the criminal liability of notaries affiliated with banking institutions for the guarantee binding act in the form of a deposit connected to the principle of bank secrecy in Indonesia. Through the analysis of relevant laws, including Bank Indonesia Regulation No. 2 of 2000, Notary Position Law, and Bank Confidentiality Law, the study aims to answer two research questions: the form of criminal liability of notaries affiliated with banking institutions for the guarantee binding act and the ideal concept of criminal liability. The findings suggest that notaries who breach the principle of bank secrecy can face criminal charges, and the ideal concept of criminal liability should balance the interests of customers and banking institutions while maintaining bank secrecy and customer privacy. The study's implications call for clear guidelines and regulations for notaries' responsibilities in guaranteeing binding acts related to deposits and penalties for notaries who violate the principle of bank secrecy.

Abstract

El objetivo de este artículo fue evaluar la capacidad de respuesta del sistema sancionador aplicable a los concesionarios, permisionarios y autorizadores de servicios de radiodifusión en Brasil. La investigación utilizó la teoría responsiva de la regulación de Ayres y Braithwaite como parámetro para el análisis crítico del sistema sancionador para la radiodifusión brasileña. La investigación reveló que el sistema sancionador no incentiva el cumplimiento de las obligaciones legales, contractuales y normativas, ya que las sanciones no estimulan el diálogo entre regulador y regulado, existe un obstáculo legal para la aplicación de la pena máxima, la casación y la prescripción de multas. en el pasado. Los resultados de esta investigación podrían apoyar a los reguladores brasileños en el desarrollo de un sistema sancionador más receptivo y eficaz para los servicios de radiodifusión. La investigación introduce la discusión sobre la capacidad de respuesta en el modelo regulatorio de radiodifusión brasileño.

Abstract

This article aims to broaden the understanding of the diversification of public responsibilities present in the intention of legislators to regulate the right to privacy and oblivion in Bill 7881/2014 and PLS 181/2014. The text adopts deductive reasoning, descriptive methodology combined with discourse analysis and theoretical framework in the General Theory of the State to explain the course of intervention that flows into the Regulatory State. The study identifies the international and economic inspiration of legislative proposals that aim to meet the demands of technological communication in a new market of data and information appropriation by corporations. The article strengthens the thesis of the diversification of public responsibilities and points out difficulties for the effectiveness of the proposed regulation due to the technical complexity and the asymmetry between users and research providers regarding the access and use of contents stored in the virtual world. The article points out contractual risks of the intense flow of exchanges on the internet and warns of the absence of a transnational State that will protect the right to privacy and oblivion globally, in the face of the power of large corporations.

Abstract

Act of corruption, an act that already exists at an alarming level in Indonesia. The element against the law in corruption cases is essential and determines the existence of a criminal act of corruption that must be accounted for, both positional responsibility and personal responsibility. The consequences of personal responsibility are related to criminal responsibility. This research will be carried out to see how the form of unlawful acts does not meet the elements of corruption and how the concept of legal certainty for unlawful acts does not meet the elements of corruption. This research will be carried out using normative juridical research. This research will then be carried out using the Statute Approach and Case Approach. The results of this study then found at least seven types of formulations in criminal acts of corruption in Law No. 31 of 1999 in conjunction with Law No. 20 of 2001. Suppose an act is considered to have violated the law and can be subject to criminal sanctions. In that case, two elements must be fulfilled: the actus reus (physical element) and mens rea (mental element) elements. The element of actus reus is the essence of the crime itself or the act committed, while the element of mens rea is the inner attitude of the perpetrator at the time of committing the act.

Abstract

El documento examina tres interrogantes fundamentales relacionadas con la eficacia de la burocracia y la burocratización. Las preguntas son: 1) ¿cuánta burocracia pública es suficiente y cómo se puede optimizar el tamaño de la burocracia?; 2) ¿cuáles son los modelos normativos de burocracia y cómo elegir entre ellos?; y 3) ¿cuáles son los fines de la bu-rocracia y, en concreto, cómo lograr una burocracia “centrada en los valores públicos”? En la medida de lo posible, el documento responde a estas preguntas en el contexto de una serie de variables contingentes, especialmente la cultura política, asunto de mayor interés para los países de América Latina. En pocas palabras, el documento concluye que la optimización del tamaño no es significativa sin la especificación previa de un gran número de variables contextuales, de las cuales se detallan sus componentes más importantes. Los modelos normativos revisados, después de evaluar la idea de “fallas de la burocracia”, corresponden a la contención de costes, a la competencia neutral y a las nociones de valor público. El documento concluye sugiriendo que la clave de una burocracia centrada en el valor público consiste en establecer un alto nivel de profesionalismo y observar un alto grado de autonomía burocrática.

Abstract

Sharia fintech is a form of financial technology that is growing rapidly in Indonesia. This study aims to analyze how users' perceptions and preferences regarding the application fintech Dana Syariah. The method used is the descriptive analysis of data consisting of 100 user reviews that have used fintech Dana Syariah from the Google Play Store. The results of this study are that the majority of respondents have positive reviews of the application. Reviews are grouped into 4 categories consisting of 2 positive categories namely ease of use and friendly service and 2 negative categories namely difficulty using the application and difficult verification.

Abstract

The purpose of this study was to analyze the role of corporate social responsibilty (CSR) in improving people's welfare. The approach used in this research is a combination of quantitative and qualitative. The research location is PT. Pertamina (Persero) RU VI in Balongan Indramayu, West Java. Data collection techniques were carried out by survey methods, participatory observations, and in-depth interviews. The survey method was carried out by distributing questionnaires to the corporate social responsibilty (CSR) recipient communities, and observation and interviews were conducted to find out the experiences, understandings, and in-depth meanings of the participants' actions. The focus of the research topic is corporate social responsibilty (CSR) and community welfare. The findings reveal two main topics. First, quantitatively corporate social responsibilty (CSR) has a very large influence on improving the welfare of the community receiving CSR funds, so it is necessary to increase the increase in corporate social responsibilty (CSR) provided to the community, as well as the need to expand the scope of the location of the recipient community. Second, qualitatively, corporate social responsibilty (CSR) which is currently being implemented has a positive impact on people's welfare. However, it is necessary to improve other principles of business ethics, namely the principles of honesty, fairness, autonomy in order to create effective business ethics in a common framework. The government needs to support and provide strict supervision of the implementation of corporate social responsibilty (CSR) programs in order to be able to have a positive impact on improving people's welfare.

Abstract

This study aims to assess the character building of students who learn using the POE2WE learning model. Character building, which is the focus of research, is religion, nationalism, integrity, cooperation, and autonomy. The study sample consisted of 170 students from 284 students at Siliwangi University, Galuh University, and Institute of Health Science of Ministry of Health in Tasikmalaya. It was selected using a purposive sampling method. The research method is survey research. The validity and reliability of the instruments were measured using the Alpha Cronbach and Pearson's correlation. The results showed that students have good religious character, nationalism, integrity, cooperation, and autonomy in learning. Meanwhile, there was a relationship between religious character, nationalism, integrity, cooperation, and autonomy in learning. Finally, this study shows that the POE2WE learning model contributes to developing character education for students to face the challenges of the 21st century.
